MINUTES
NOVEMBER 14,

The meeting was called to
order by Chairman Thornton at 7:00 p.m.
MEMBERS PRESENT: Mr. Thornton, Mr. Faulkner, Mr.
McMannis, Mr. Mickley, Mrs. Timmons
OTHERS PRESENT: Zoning Inspector McCoy, Clerk Patterson,
Andrew Maletz, Donald & Patricia Jordan, Mike White
APPROVAL OF MINUTES: Mr. Mickley asked to make an amendment
to Page 9, first paragraph, 12th line from the top. The word “some” should read “sum”. Minutes were approved as
amended.

Requesting a conditional
use to permit dog boarding/daycare and grooming in the SD-1 zoning district; to
be located at 1008 Columbus Avenue, Lutz Commerce Park, filed by Ami Cooksey, 54
W. Maple Street, North Lewisburg, OH
43060 (tabled at October 10, 2005 mtg.)
This was tabled at the last
meeting. Applicant sent a letter
requesting to table to the next regularly scheduled
meeting.

Requesting a variance to
permit 20’ rear setback for construction of a deck vs. 30’ rear setback
required; R-3 Zoning District, filed by Patricia Jordan,
COMMENTS OF ZONING
INSPECTOR AND/OR CITY PLANNER: Ms.
McCoy stated 30’ is the required setback in the R-3 Zoning District and they are
requesting 20’.
COMMENTS OF REQUESTER: Don and Patricia Jordan addressed the
Board. They want to build a 12 x 12
deck on the back of their home. Ms.
Existing lot coverage is
31’; 35’ is allowed in R-3.
Neighbors are fine with them building a deck. Felt it would improve the
area.
COMMENTS OF CITIZENS: No comments.

the variance, seconded by Mr. Mickley and the question put,

Requesting a conditional
use to permit an elementary school be constructed; R-2 Zoning District; to be
located at
COMMENTS OF ZONING
INSPECTOR AND/OR CITY PLANNER:
According to Codified
Ordinance 1137.13(b), public and quasi-public use is a conditional use in the
R-2 Zoning District.
COMMENTS OF REQUESTER: Mr. Andrew Maletz, architect with Steed
Hammond Paul, addressed the Board. Displayed the site plan for
the Board’s reference. The
project is on the
Pick up and drop off times
will vary between the Intermediate and Elementary Schools. Board questioned parking lot
lighting. The lighting will be
directed downward. Since this is a
residential neighborhood, lighting accommodations will be made accordingly. Board expressed concern for excess
traffic. Ms. McCoy stated
Administration expressed concern about traffic, but it will be worked out. The City is on board with the location
for this school. Applicant stated
the drop-offs are strategically located to avoid traffic
problems.
Anticipated enrollment is
550 with enough room for potential expansion of six additional classrooms with
an average of 20/25 per class.
Building is scheduled to open fall of 2007 with less than 500 enrollment.
Foot traffic will utilize
the sidewalk which will go around the site, following Creekview. Will probably run
connections in both directions, depending on traffic.
COMMENTS OF CITIZENS: No comments.

the conditional use, seconded by Mrs. Timmons and the question put,

Conditional use was
granted.
Due to upcoming changes to
the Board of Zoning Appeals, i.e. adding two new members to the Board, Mr.
Thornton requested the Clerk send a copy of the current Rules of Procedure to
all board members to see if changes are needed due to this change.
Mr. Thornton suggested
reviewing the current code to identify areas of concern. Mr. Mickley volunteered to do that.
ADJOURNMENT: There being no further business to come
before the Board of Zoning Appeals, the meeting adjourned at 7:35
p.m.
