TALKING POINTS RE: TWIGG PROPERTY REZONING REQUEST

 

 

Property Location & Owners

·        Owners are Mary Elizabeth Twigg & John D. Hoffman

·        Located along Mill Road between Mill and SR 33 bypass along SR 31

·        Request has been made to rezone approximately 18.5 acres from BR to B1 of approximately 29.7 acres in this area.  Remaining 11.2 acres is presently zoned B1

Proposed Re-zoning & Owner’s Tentative Plans

·        Property owners have asked that the current zoning of the 18.5 acres (BR) be amended to B1.

·        Current owners have plans to sell all 29.7 acres to Casto Development Corporation who will in turn plat the property, build buildings to suit tenants, and lease the buildings to tenants.  The Kroger Company would possibly be one of those tenants, relocating their Marysville store to this location in an expanded format to include a fuel station.

·        City Planning Commission recommended on 12/3-07 with a split 4-3 vote that City Council approve the rezoning request.

 

 

 

CITY COUNCIL CONSIDERATIONS IN RELATION TO THE REZONING REQUEST:

 

Comprehensive Plan

·        Both the 1993 and 1999 Comprehensive Plans for Union County and the City of Marysville recommended this area develop with commercial and office uses

·        The proposed rezoning request meets the location and infill requirements of the Comprehensive Plan

·        The 1999 Comp Plan recommends use of Planned Unit Development Districts for commercial areas

 

City Staff Input

·        These properties can be developed commercially now under its current zoning.  Development of this property under either zoning use will impact the surrounding properties equally.  Level of that impact would depend upon the exact user placed upon the properties.

·        Traffic congestion along SR 31 would be further impacted by any development of these properties.  Any development here would be required to participate in the costs of necessary improvements, including traffic patterns.  The City is currently in the middle of completing a city-wide traffic study of which this area is a primary focus.  Additional traffic studies may be required of the developer for this specific site plan.

·        Public sentiment about the development of this property as well as the property rights of the owner must be carefully and legally considered.

·        Consideration should be given to the economic partnership Kroger has had with the community for many years.  Kroger wants to invest more dollars in our community, which is a good thing; however, Council must weigh all impacts on the community.

 

Calendar of Milestones

·        November 7, 2007- Application made by owners for rezoning amendment

·        December 3, 2007- Planning Commission votes to recommend approval of rezoning to City Council

·        December 20, 2007- City Council conducts first reading of legislation to approve rezoning

·        January 10, 2008- City Council conducts second reading, public hearing of legislation to approve rezoning

·        January 24, 2008- City Council conducts second public hearing (required for all zoning matters) of legislation to approve rezoning; Council tables final reading/public hearing until February 28, 2008

·        Council’s final reading/public hearing and ensuing vote on the requested rezoning will therefore be conducted February 28, 2008 meeting (7:00 p.m. at City Hall, 125 E. Sixth St.)
