NOTICE: Swimming Pools Residents
should contact the Zoning Department at (937) 645-1028 or (937)
645-1046 before installing a swimming pool of any size, even the
smaller, above-ground inflatable style swimming pools to assure
zoning requirements are met. According to the City of
Marysville Codified Ordinance 1139.03, a private swimming pool,
or the entire property on which it is located, shall be walled
or fenced to prevent uncontrolled access by children from the
street or from adjacent properties. Such fence or wall
shall not be less than four feet in height, maintained in
good condition with a gate and lock, and meet the barrier
requirements as established in the swimming pools, spas and hot
tub appendix of the Ohio Residential Code. Swimming pools
must also be located at the rear of a residence and if a corner
lot, shall not be closer to the street line than the residence
and shall be located at least 10 feet from any property line.
These regulations apply to any swimming pool that contains
water over 24" deep.
NOTICE: Fence Regulations
The City of Marysville's fence code regulates the height and
location of fences. No functional fence shall be erected
to a height exceeding six feet. A functional fence may be
placed on the side or rear property line, but may not be placed
closer to the street than the front of the main building (except
in A-R zoning districts). On a corner lot, both streets
are considered frontages.
When decorative fences are placed closer to
the street than the front of the main building on any lot, the
maximum height of the fence shall be three feet and shall not be
sight obscuring. Please call the Zoning Department at

decorative fences for corner lots.
The smooth finished side of the fence shall
be the side of the fence that faces outward from the yard being
fenced. All of the framing or support members shall face
inward of the yard being fenced.

The
Code & Zoning Specialist has the following duties:

Upon finding that any
provision of the Zoning Ordinance is being violated, the
person responsible for the violation shall be notified in
writing ordering the action necessary to correct such
violation;

Order discontinuance
of illegal uses of land, buildings or structures;

Order removal of
illegal buildings or structures or illegal additions or
structural alterations;
-
Order discontinuance
of any illegal work being done;
-
Take any other action
authorized by the Zoning Ordinance to ensure compliance with
or to prevent violations of this Zoning Ordinance.
This may include the issuance of and action on zoning
permits and such similar administrative duties as are
permissible under the law.
The Code & Zoning
Specialist also coordinates Board
of Zoning Appeals applications, Minor Lot Split Applications,
Major Lot Split Applications, and serves as Secretary for the
Design Review Board for enforcement of the Landscape Ordinance,
Historic Uptown Marysville Ordinance and Design Review
